Further Leave To Remain Solicitors
If you need more time in the UK, the first question is which route permits you to stay. Further leave to remain describes additional temporary permission; it is not a single visa with one set of eligibility rules, fees or conditions.

Further permission rather than settlement
Further leave to remain, often called FLR, is permission to continue staying for a limited period. Depending on the rules, you may extend an existing route or apply to switch to another route from inside the UK.
The application must have a valid legal basis. A form abbreviation, time already spent in the UK or a wish to avoid leaving does not establish eligibility. Temporary permission also does not automatically carry the same conditions or settlement pathway as an earlier visa.
Identify the route before choosing the form
A partner or parent may apply under the relevant family provisions. Private-life applications have separate eligibility tests based on matters such as age, residence and circumstances in the country of return. They are not interchangeable with a normal partner extension.
Work-route extensions use the conditions of the particular work visa. Permission on the long-residence route can be available where the required ten-year lawful and continuous period and other relevant requirements are met but English or Life in the UK requirements for settlement are not.
Use the current GOV.UK instructions for the route, rather than selecting a form solely because it is labelled FLR. Visitors and other categories may be restricted from switching in-country.
Apply before expiry and check validity
Check the expiry date of your actual immigration permission and prepare the correct evidence in time. Starting or saving an online form is not the same as submitting a valid application. Payment or an applicable waiver, identity evidence and required procedural steps all need attention.
For family extensions, it is possible to apply before expiry, but only up to 28 days of remaining permission may be added when extending with the same family member. Applying early without checking the settlement timetable can create a need for another extension later.
When section 3C may protect existing permission
Section 3C can extend existing limited leave where a person makes a valid in-time application to vary it and their leave expires while the application remains undecided. It does not mean that every pending application creates lawful status.
A late application does not trigger section 3C in the same way, and invalidity, withdrawal, a decision or subsequent challenge can affect the position. Existing conditions generally continue during section 3C leave; an application to change route does not itself give the work rights of the route sought.
Section 3C leave ends if the person leaves the UK. Travel can also affect a pending application. Obtain advice before travelling or changing work arrangements while a decision is pending, particularly if your original permission has expired.
Evidence follows the reason for staying
A family application may require relationship, financial, accommodation and English evidence. A private-life application instead needs evidence supporting the particular residence or personal-circumstances provisions relied upon. A worker’s extension has its own sponsorship and eligibility requirements.
Provide a clear account of changes since the last application and disclose earlier decisions or periods without permission. If status has already expired, do not assume a short grace period restores permission; the circumstances and any available exception need individual assessment.
- Current permission, previous decisions and the expiry date.
- Evidence supporting the chosen route and any changed circumstances.
- Identity records and required translations.
- An explanation and supporting documents for any exception being relied upon.
Understanding the next grant
An extension grants the period and conditions set by the route. It may not advance settlement in the same way as your previous permission. Check the decision, expiry date, work conditions and any restrictions before relying on the new grant.
Highfin’s existing FLR material covers family, private-life and other extension enquiries. When contacting the team, give the expiry date and the reason you need further permission. Ask it to confirm which advice is available and agree the scope and costs before instruction.
Official guidance
- Route-specific charges
- There is no universal FLR fee or processing period. Check the selected route’s charges, any healthcare surcharge and whether a fee waiver is available for that application.
- Protect the timetable
- Gather the documents and identify any application-validity issues before the expiry date. A looming deadline or existing overstay should be raised promptly with an adviser.
- Confirm Highfin’s assistance
- Ask for confirmation of the proposed extension advice, submission work and professional charges. Emergency availability and any particular response time are not promised.
Frequently asked questions
Your questions
Is FLR a single visa category?
No. The expression describes further temporary permission. The actual family, private-life, work or other route determines eligibility and the application process.
Does saving an application online protect my status?
No. Saving a draft is not submission. Any section 3C protection depends on the relevant conditions, including a valid application made before existing leave expires.
Can I start a new type of work while my application is pending?
Do not assume so. Where section 3C applies, the existing conditions generally continue. Applying for a different route does not itself grant that route’s work rights.
Can I travel while relying on section 3C leave?
Section 3C leave ends on leaving the UK, and travel may also affect the application. Seek advice before making arrangements while a decision is pending.
Can long residence provide a temporary extension?
It can in qualifying cases where the lawful and continuous ten-year period and relevant requirements are met but settlement English or Life in the UK requirements are not. It is not a way to complete a shortfall in the required ten-year period.
