Letters Of Administration Solicitors

Letters of administration may be required when an estate needs a grant but there is no executor able to obtain probate. The first question is whether there is a valid will: administration on intestacy and administration with the will annexed have different foundations. Highfin's published estate-administration service includes assistance with grants; this guide focuses on establishing who may apply and the authority sought in England and Wales.

Establish entitlement before applying for the grant

Check whether the estate needs a grant

List the assets and how they are owned, then establish what the organisations holding them require. Some estates can be dealt with without a grant; there is no universal account-value threshold that applies to every provider.

A lack of a will does not automatically make an application necessary. Conversely, tax and administration duties can remain even when no grant is required. The Probate page explains the wider choice of grant.

  • Probate and grant requirements

Distinguish the two administration routes

On intestacy, there is no valid will governing the estate and entitlement is determined by the applicable statutory rules. Search for a will and codicils before treating the estate as intestate.

Where there is a valid will but no executor able or willing to take the grant, administration with the will annexed may be appropriate. The will still matters to distribution; the absence of an acting executor does not cancel it. A partial intestacy or disputed document needs separate examination.

  • Where there is a will

Establish who has priority to apply

On intestacy, the statutory order ordinarily starts with a surviving spouse or civil partner, followed by children and the further classes specified in the rules. Descendants of a deceased child and other family circumstances require the full rules to be checked. Being an unmarried partner does not by itself confer the same entitlement.

Where a will exists, priority under rule 20 depends on roles and interests under that will, rather than simply identifying the nearest relative. Establish why any executor or person with prior entitlement is not applying. Minors, life interests, incapacity or competing applicants may require additional representatives, evidence or directions.

  • Priority where there is a will

Prepare the entitlement and estate evidence

Gather the death details, original will and codicils where applicable, evidence of relationships or beneficial interests, and information explaining anyone with prior entitlement. Check the correct procedure for renunciation or an application through another authorised person rather than treating informal family consent as sufficient.

Value the assets and liabilities and identify relevant tax information. Check the excepted-estate conditions and whether HMRC requires an IHT400 account; a nil tax bill does not always remove full reporting. Probate values and Inheritance Tax values can differ.

Use the route appropriate to the application

Current HMCTS guidance distinguishes online eligibility from cases needing a paper application. PA1A is the relevant paper application where there is no will; a will-annexed application uses the will route and requires the appropriate supporting explanation and original documents.

Requirements differ for personal applicants and practitioners. Confirm the declaration, supporting documents, HMRC prerequisites and current application charge before submission. A query about entitlement or a missing document can require further work; no fixed grant date is assured.

Treat the grant as the start of authorised administration

The grant identifies the administrator's authority; it is not permission to ignore debts, tax or the rights of beneficiaries. Check the grant and any limitations before presenting it to asset holders.

Estate collection, accounts and distribution remain separate responsibilities. If entitlement, will validity or administration is contested, identify the dispute and obtain advice on the appropriate procedure before assuming a routine application can resolve it.

Preparing the enquiry
Identify the deceased, whether a will has been located, your relationship or interest, any other people with entitlement and the known assets. State whether a grant or application already exists.
Grant-only or wider assistance
Agree whether the instruction concerns obtaining authority or administering the estate through to distribution. Highfin's fees and terms require confirmation; the separate pricing page remains pending approved information.

Frequently asked questions

Your questions

Can letters of administration be issued when there is a will?

Yes. Administration with the will annexed may be needed where no executor can take probate. Priority and the position of named executors must be addressed; the will is not disregarded.

Does the eldest child automatically have priority over other children?

Birth order alone does not give priority within the same entitled class. The statutory order, any prior-entitled person and the position of all potential applicants need consideration.

Can an unmarried partner apply simply as next of kin?

An unmarried partnership alone does not give the intestacy entitlement of a spouse or civil partner. Other interests or a special procedural route may require individual advice; do not assume informal family agreement creates entitlement.

Is a grant unnecessary whenever no Inheritance Tax is due?

No. The need for a grant depends on assets and ownership, not just tax. Reporting obligations must also be checked separately.

Can the administrator distribute immediately after obtaining the grant?

Not simply because the grant has arrived. Liabilities, tax, beneficiary entitlement and potential claims must be considered as part of the wider estate administration.
