Rent Arrears Solicitor
Rent arrears can threaten a tenant's home and leave a landlord with a growing unpaid balance. Highfin's published Housing service includes rent recovery and consideration of arrears solutions. This page separates checking the debt, agreeing repayment and deciding whether a money claim or possession route is appropriate.

Establish what is actually owed
Compare the agreement and lawful rent changes with a dated schedule of sums due and payments received. Check credits, benefits paid to the landlord, disputed charges and any agreement already reached. A headline balance is not a substitute for an accurate account.
A tenant should explain disputed entries and provide receipts or bank records. A landlord should be able to show how the balance was calculated. Keep repairs or other possible claims identifiable rather than assuming they automatically cancel rent.
- The agreement and evidence of the rent payable.
- A running account, payment receipts and relevant benefit correspondence.
- Earlier repayment arrangements, notices and claim documents.
Consider an affordable repayment arrangement
Discuss whether ongoing rent and an affordable contribution to arrears can be paid. Record the amounts, dates and review arrangements. A proposal should reflect the person's circumstances; agreement about the debt should also clarify what happens to any existing proceedings.
Where a qualifying debt is included in breathing space, creditors must apply the statutory restrictions on recovery, contact and enforcement. This is not a write-off or a general rent holiday: ongoing rent is treated separately. Check the notification and obtain advice before taking further action.
A money claim is not a possession claim
Recovering an unpaid balance and recovering occupation are separate objectives. A claim for money may be considered even after the tenant has left; an order to pay does not itself give possession or guarantee collection.
Identify the applicable pre-action procedure. The Debt Claims Protocol covers a business claiming a debt from an individual, subject to its exclusions. It requires information about the debt, supporting material and reply documents, with an initial 30-day response period and further safeguards where advice or documents are requested.
Social landlord possession claims have a separate protocol, including early contact about arrears and benefits, information exchange and reasonable payment arrangements. Do not apply one protocol indiscriminately to every landlord or every type of claim.
Current English private-tenancy possession grounds
For private assured tenancies governed by the reforms from 1 May 2026, Ground 8 generally requires at least three months' unpaid rent where rent is monthly, or 13 weeks where weekly or fortnightly, at both notice and hearing. Amounts unpaid only because an entitled Universal Credit housing payment has not yet arrived are disregarded.
Grounds 10 and 11 address unpaid rent and persistent delay on a discretionary basis. Possession is not automatic after a missed payment: the pleaded ground, statutory conditions and applicable court powers matter. Current private arrears grounds carry four weeks' notice; the new thresholds must not be applied indiscriminately to saved or social cases.
An accurate updated account can change the assessment at a hearing. Paying down the balance may affect Ground 8 but does not necessarily dispose of another ground. Identify all grounds relied upon before assuming the claim has ended.
Assess the practical outcome
Before litigation, consider the evidence, possible responses, costs and realistic prospects of recovery. If a claim is issued, comply with directions and keep the rent schedule current. A repayment discussion does not automatically suspend a hearing or change an existing order.
Enforcement of a money judgment and enforcement of possession use different mechanisms. Ask Highfin to assess the route and confirm its instruction and charges. Neither eviction nor payment is guaranteed, and arrears do not authorise harassment or self-help removal.

Frequently asked questions
Your questions
Does one missed payment automatically justify eviction?
No. The legal status of the occupation, available ground, notice and court process must be assessed. Discretionary and mandatory grounds have different requirements.
Can arrears still be claimed after the tenant leaves?
A relevant debt may remain, but liability, evidence, time limits and the appropriate recovery process need checking. Departure does not guarantee either cancellation or recovery.
Does a repayment offer stop court proceedings?
Not automatically. Record any agreement and address existing proceedings and orders properly. Follow court deadlines while a proposal is being discussed.
Does Universal Credit erase the rent debt?
No. The current English Ground 8 calculation has a specific disregard for qualifying unpaid housing awards. That is not a general cancellation of arrears.
Are Welsh arrears thresholds the same as England's?
No. Welsh occupation contracts have their own grounds, thresholds and notice restrictions. The contract type and payment period matter.
