Asylum and Refugees

Understanding protection and the next legal step

Discuss your Asylum and Refugees enquiry

Sources checked on 12 October 2026. This general information does not assess your individual circumstances.

Asylum, refugee status and humanitarian protection

Asylum is the process of asking for international protection. Refugee status recognises a well-founded fear of persecution for a Refugee Convention reason: race, religion, nationality, political opinion or membership of a particular social group. The assessment considers the individual risk and whether effective protection or a safe and reasonable place to live elsewhere in the country is available.

Humanitarian protection is different. It may apply where someone does not qualify as a refugee but faces a real risk of specified serious harm on return, subject to the relevant requirements and exclusions. Serious harm includes torture or inhuman or degrading treatment and certain threats arising from armed conflict.

Neither route is a general alternative to a work, study or family visa. An asylum claim concerns protection from return, not simply a preference to remain in the UK.

A new claim or an existing case

A claim made in the UK or at a UK port of entry begins with registration and an assessment of whether it can be considered here. Travel history and a connection with a safe third country can be relevant. Passing through another country does not make every case identical, and an inadmissibility issue needs individual advice.

For an existing claim, the next task may be responding to a questionnaire, preparing evidence, attending an interview or explaining a change in circumstances. The detailed application page explains these stages, including the possibility of a combined Single Protection Interview.

A grant of protection is not automatically settlement

Refugee status or humanitarian protection is accompanied by immigration permission with its own conditions and expiry date. Grant length now depends on when the claim was made and relevant exceptions. Do not rely on legacy statements that every successful claim gives the same period of leave or automatically leads to settlement.

The decision letter and current guidance should be checked for the permission granted, any dependants and future application requirements. A dependant’s permission does not necessarily mean they have refugee status in their own right.

Refusals, appeals and other challenges

A protection refusal may carry a right of appeal to the independent First-tier Tribunal. The decision, any certification and the person’s location affect the available remedy and timetable. Obtain advice promptly and retain the decision and evidence of when it was received.

An appeal and judicial review are different procedures. Judicial review concerns the lawfulness of a decision or process and is not an automatic substitute for a merits appeal. New evidence after a refusal also needs assessment rather than an assumption that it automatically starts another claim.

Family separation and the closed reunion route

As checked on 12 October 2026, refugee family reunion under Appendix Family Reunion (Sponsors with Protection) remains closed to new applications. Applications made before 3pm on 4 September 2025 remain subject to transitional consideration under the rules then in force.

A person with protection status may need advice about a pending application or a different family route. Appendix FM and the separate Child Relative route have their own requirements; protection status alone does not guarantee that a relative can join you.

Discussing advice, evidence and funding

Highfin’s existing asylum material identifies claim preparation, evidence and interview preparation, and review of adverse decisions as areas for enquiry. The work required in your case, the firm’s availability and the scope of any representation must be confirmed before instruction.

An initial enquiry can identify whether you have registered a claim, received an interview or decision, and have an approaching deadline. You do not need to set out detailed traumatic experiences or send sensitive documents through the initial enquiry form.

Legal aid may be available for asylum matters, subject to the applicable rules, assessment and provider availability. Funding rules differ across the UK. This page does not confirm that Highfin holds a legal-aid contract or offers emergency representation.

Advice and funding
Ask for confirmation of the proposed work and any professional fees. Legal-aid eligibility and access to an authorised provider require separate checking; no Highfin funding arrangement is asserted.
An existing deadline
Keep the Home Office or tribunal notice and record when it arrived. Seek timely qualified advice about the actual deadline; the enquiry form does not accept submissions or provide urgent assistance.

Frequently asked questions

Your questions

Are asylum and refugee status the same thing?

Asylum is a request for protection. Refugee status is a possible outcome where the Refugee Convention requirements are met. Humanitarian protection is a distinct outcome with a different legal test.

Must persecution be committed by the government?

Not necessarily. Risk from other people or groups can be relevant where effective protection is unavailable. The facts, protection available and any safe and reasonable internal relocation option need assessment.

Can I claim asylum as a way to obtain a work visa?

Asylum concerns a need for protection from return. Work and study visas have different purposes and requirements; an asylum application does not ordinarily give permission to work.

Can refugees currently make a new family reunion application?

As checked on 12 October 2026, the Appendix Family Reunion route remains closed to new applications. Pre-3pm 4 September 2025 applications and possible alternative family routes need separate consideration.

Does every refusal have the same appeal procedure?

No. Read the decision and any certification, and check the available remedy and deadline promptly. An appeal, judicial review and further submissions are not interchangeable.

Does Highfin provide legal aid for asylum cases?

Highfin's availability to undertake legally aided work must be confirmed. Asylum legal aid may be available through an appropriate provider, subject to eligibility and funding rules; Highfin’s arrangements must be confirmed.
