Business Immigration Solicitors

Recruiting from overseas and establishing a UK business involve different immigration routes. Understand the organisation’s responsibilities, the proposed role and the applicant’s requirements before committing to a recruitment or relocation plan.

Planning business immigration

Who business immigration advice is for

Business immigration can concern an employer seeking permission to sponsor workers, an existing sponsor managing its duties, or a founder exploring a route to develop an innovative business. The company’s needs and the individual’s immigration position should be considered together.

Highfin’s existing business immigration pages describe sponsorship and visa-application advice. An enquiry can set out your proposed recruitment or business activity and ask the firm to confirm the assistance available. Do not assume that every global mobility route or compliance service is covered without agreeing the scope.

Sponsorship and founder routes

The Skilled Worker route links an eligible job to an approved employer and a sponsored worker’s application. A sponsor licence may be required, but some people already have permission to work without sponsorship. Check that position before planning a licence application.

Innovator Founder concerns an endorsed business proposal and the founder’s eligibility. It is not a substitute for ordinary employer sponsorship. Other routes, such as Global Talent or Scale-up, have distinct requirements and should be considered on their own terms.

Assess the organisation and the individual separately

For sponsorship, the business needs suitable management and monitoring systems as well as an appropriate licence. The job must qualify for the intended route. Its actual duties, occupation code and salary matter, rather than the job title alone.

The individual must meet the visa’s requirements. These can include English-language evidence, financial support and route-specific suitability conditions. Existing permission or earlier sponsorship may affect which transitional provisions apply; an old salary figure should not be reused without checking.

Information that helps assess a recruitment plan

Prepare an accurate account of how the organisation operates and why the role is needed. Documentary requirements differ between licence applications and individual visas, so there is no single business immigration checklist.

  • The company’s activities, structure and any existing sponsor licence.
  • A job description showing duties, pay, hours, occupation code and proposed start date.
  • The proposed worker’s current location, immigration permission and relevant qualifications.
  • For a founder, the business proposal, funding position and any endorsement correspondence.

Plan for an application and ongoing duties

A licence assessment, a certificate of sponsorship and a visa application are different stages. Build the plan around the stage you have reached, the evidence still needed and any employer responsibilities that continue after the worker starts.

The requirement to renew a sponsor licence every four years was removed in April 2024. Licences remain subject to compliance, and certain routes have time-limited licences. Do not treat an old renewal schedule as current guidance.

Ask Highfin about reviewing route choice and application evidence, and confirm separately whether any ongoing compliance work is available. Published processing estimates and priority services are not a guarantee of a recruitment date.

Fees and next steps

View enquiry arrangements
Separate the costs
Employer licence and sponsorship costs, visa charges, any applicable health surcharge and legal fees serve different purposes. Confirm which party must pay each cost; sponsor licence fees and related application costs must not be passed to the sponsored worker.
Define the instruction
Set out whether the proposed work concerns a licence, an individual visa or continuing sponsor duties. Confirm the legal fee, VAT, disbursements and any excluded work before proceeding.
Keep plans conditional
Do not base travel or a start date on an assumed approval. Check current official processing guidance and the consequences of any existing immigration conditions.

Frequently asked questions

Your questions

Does every overseas recruit need sponsorship?

No. Some individuals have permission to work without sponsorship, including people with indefinite leave to remain or EU Settlement Scheme status. Check the person’s right to work and any conditions before choosing a route.

Can a business proposal alone secure an Innovator Founder visa?

No. Endorsement is required, and the applicant must meet the immigration requirements as well. Business funding and personal maintenance are separate considerations.

Must a sponsor licence still be renewed every four years?

The general four-year renewal requirement was removed on 6 April 2024. Scale-up and UK Expansion Worker licences have specific duration limits. Compliance duties continue, and a licence can be revoked.

Can a sponsor licence fee be recovered from the worker?

Official guidance requires the sponsor to pay the licence fee and warns that recovering that fee or related application costs from the worker can lead to revocation.
