Tenancy Deposit Dispute Solicitor

A disagreement about deductions is different from a failure to protect a deposit. Highfin's published Housing service includes deposit-return disputes. Establishing which issue you face, where the home is and how the deposit was handled helps identify the right evidence and resolution route.

Tenancy Deposit Disputes

Protection, deductions and the route to repayment

Identify the payment and the legal framework

Check whether the payment was a tenancy security deposit rather than a holding deposit or rent paid in advance. Keep proof of who paid it, to whom, when and for which agreement. Different payments and occupation types can attract different rules.

In England, current Housing Act deposit provisions refer to assured tenancies following the May 2026 reforms, subject to relevant savings and transitional provisions. Do not assume that older guidance referring only to assured shorthold tenancies gives the whole current position. Welsh occupation contracts have a separate statutory basis.

  • Housing Act: protection and information duties
  • Renting Homes: deposit requirements

Check protection and the required information

For deposits within the English statutory regime, the landlord must comply with the scheme's initial requirements and supply prescribed information within 30 days of receipt. Registration and information are distinct duties. In Wales, section 45 similarly requires scheme compliance and the required information within 30 days of payment.

The government-approved schemes listed in the guidance are the Deposit Protection Service, MyDeposits and the Tenancy Deposit Scheme. Check directly with the identified scheme if the certificate or account status is unclear. A custodial scheme holds the money; an insured arrangement protects it while it is held outside the custodial scheme.

Assess each proposed deduction

Ask for an itemised explanation and evidence for any proposed deduction. Compare the agreement, check-in and check-out records, photographs and payment history. Distinguish damage or unpaid sums from ordinary use and wear; a deduction should not simply be accepted because it is described as a cleaning or replacement charge.

Explain each point of disagreement clearly and keep copies. Relevant considerations include the condition at the start, responsibility for the issue and the basis of the sum claimed. The dispute process evaluates evidence rather than guaranteeing a full return.

Use the scheme's repayment and dispute process

Ask for the agreed balance to be released and check the scheme's procedure and deadlines promptly. GOV.UK describes repayment within 10 days of agreement on the amount; that is not a promise of full repayment ten days after moving out where a dispute remains.

Approved schemes offer a free dispute-resolution service for eligible disagreements about the deposit. Both parties must agree to use it, provide their evidence and accept its final decision under the scheme's rules. Confirm eligibility and time limits rather than letting correspondence continue indefinitely.

If adjudication is unavailable or not agreed, obtain advice on the appropriate court route and costs. Do not assume an adjudicator can determine every claim connected with the tenancy.

Separate a protection breach from a deductions decision

A claim that the landlord failed to comply with protection or information duties is distinct from scheme adjudication about deductions. For a qualifying English claim, section 214 provides county-court remedies; where the statutory conditions are established, the monetary sanction is between one and three times the deposit. The court determines the amount, and repayment or protection orders depend on the circumstances.

Welsh occupation-contract claims use Schedule 5 to the Renting Homes Act, with provisions for ongoing and ended contracts and a one-to-three-times sanction where the relevant conditions are met. Establishing the applicable breach and evidence is essential; neither the maximum sanction nor successful recovery is automatic.

Earlier deposits, renewals, changes of landlord, remedial action and transitional rules need individual review. A deposit issue can also affect possession proceedings, but it should not be assumed to stop every eviction.

Prepare a focused enquiry

Tell Highfin whether the issue is an unpaid agreed balance, disputed deductions, missing protection or missing information. Include the deposit amount, payment date, scheme, property location and whether the occupation has ended.

Ask the firm to confirm whether it can assist with correspondence, a scheme dispute or a court claim and how charges would be calculated. Keep any scheme or court deadline in view. The website form is not accepting submissions.

Frequently asked questions

Your questions

Is a holding deposit protected in the same way?

Do not assume so. A payment to reserve a property and a security deposit for the tenancy are different. Identify what was paid and the rules applying to that payment.

Does registering the deposit alone satisfy the duties?

Not necessarily. The applicable regime also requires information to be given within the statutory period. Check the actual documents and service history.

Can the scheme award the statutory protection penalty?

Scheme adjudication concerns allocation of the protected deposit. A statutory claim for breach of protection or information duties is a separate county-court matter.

Will I automatically receive three times the deposit?

No. The relevant statutory conditions must be established and the court determines the sanction within the applicable range. A deduction dispute alone does not prove a protection breach.

Must the whole deposit be returned ten days after I leave?

The GOV.UK repayment statement runs from agreement about the amount to return, not simply departure. Check the scheme's process where all or part remains disputed.
