Legal service
Landlord Solicitors
Residential letting involves continuing obligations as well as decisions about rent and possession. Highfin's published Housing service includes landlord disputes, possession proceedings and rent recovery. This overview helps landlords identify the issue, organise the relevant records and choose the appropriate specialist advice.

Establish the tenancy and the parties
Check the property's location, the agreement history, who occupies the home and who is entitled to act as landlord. A private assured tenancy, social tenancy, resident-landlord arrangement and Welsh occupation contract do not carry identical rules.
This page concerns residential landlord advice, not an offer of commercial property services. Tell Highfin who the other parties and agents are so it can check whether it can act. Advice for landlords is distinct from representing a tenant opposing the same instruction.
Keep compliance under review
Repair and safety responsibilities continue during a letting. Review the applicable gas and electrical safety requirements, deposit protection, information duties and any property licensing requirements. Which checks apply depends on the property, tenancy and jurisdiction.
Retain records of inspections, certificates, reports, access arrangements and action taken. Delegating management to an agent does not make it safe to assume every legal duty has been satisfied. Ask for evidence and address gaps before relying on a notice or making a demand.
Address payment and tenancy disputes proportionately
A clear rent account helps distinguish missed payments from accounting errors or disputed charges. Identify the contractual and legal basis of each sum, then consider a realistic repayment proposal or the appropriate recovery route.
Other disagreements may concern property use, access, repairs or deposit deductions. Preserve correspondence and define the result sought. Negotiation can be useful, but it does not authorise withholding services, taking possessions or bypassing a legal process.
Treat possession as a separate legal decision
For English private assured tenancies within the May 2026 reforms, a new Section 21 notice is no longer available. An applicable possession ground, its conditions and the correct procedure must be considered instead. A desire to sell or an unpaid balance does not itself complete that assessment.
Saved proceedings and older notices need their own chronology. Social housing was not generally brought into the new private assured-tenancy regime in May, and Welsh contracts follow separate law. Use the dedicated possession page for the evidence and steps relevant to a landlord seeking the property back.
Maintain lawful communication and access
Keep requests specific, reasonable and documented. Explain what inspection or work is proposed and follow the applicable access requirements. A disagreement about access should be addressed lawfully rather than treated as permission to enter or remove an occupier.
Threats, lock changes and interference with essential services can create serious liability. Where a tenancy has ended but an occupier remains, check the required process before taking action. The existence of arrears is not a general defence to unlawful eviction.
Prepare the instruction
Set out the property, tenancy type, problem and desired outcome. Include earlier notices or claims and any deadline; a review based only on the latest letter may miss a relevant saving or existing order.
Highfin's existing service describes negotiation, possession work and rent recovery. Ask the firm to confirm the assistance available for your matter and the proposed terms. No portfolio-management service, commercial expertise, fixed fee or particular result is promised.

Frequently asked questions
Your questions
Does this page cover commercial leases?
No. It addresses residential landlord matters. Any other property instruction needs separate confirmation rather than an assumption about Highfin's services.
Can I rely entirely on my managing agent's records?
Obtain and review the documents relevant to the issue. Agent involvement does not establish that all duties, service requirements or evidence have been satisfied.
Is recovering rent the same as recovering the property?
No. Money recovery and possession are different remedies and may involve different procedures. Decide what is sought and assess each route.
Can I change the locks once a notice expires?
Do not assume notice expiry permits removal. The occupier's status and any required court and enforcement process must be checked.
What if my property is in Wales?
Welsh occupation-contract law and relevant registration, licensing and procedural requirements need a separate assessment. English assured-tenancy templates should not be substituted.
